Law Student upset over DUI arrest because “Clearly I can’t be drunk it is now the next day”

Second year law student Miles O’Brien was arrested on his way to classes this morning for a DUI. O’Brien is completely dumbfounded at how the police could think he was drunk because he clearly slept, showered and had coffee before getting behind the wheel.

Officers made the traffic stop at about 9am this morning. There reason for the stop was O’Brien was sitting stopped for a green light. According to the police report O’Brien said we was taking a selfie for SnapChat and did not see the light change.

The police report states the officers observed that O’Brien had red, glassy looking eyes, and an odor of intoxicants was coming from the vehicle. When asked O’Brien said he had been out drinking the night before to celebrate St. Patrick’s Day. Upon additional questioning O’Brien said he started drinking about 11am and drank continually until close to midnight.

Officers asked the 22 year old to complete field sobriety tests. O’Brien initially protested the testing but did get out of his car to conduct them. According to reports O’Brien displayed eye nystagmus during the HGN tests. He also stumbled during the walk-n-turn test, and had difficulty maintaining balance for any time during the one leg stand test. Results of the preliminary breath test showed a blood alcohol content of 0.12.

After bailing out O’Brien emailed CallTheCops to express his outrage over his arrest. “This is a travesty of the justice system. Those tests are all flawed and designed to make sure everyone fails. Everyone knows breathalyzers are not accurate. I got six hours of sleep, had a long hot shower and drank two cups of coffee there is no way I was still drunk.”

O’Brien’s father is a lawyer and according to him the cops will be sorry once his dad is finished with them. We contacted his father and got this curt response “All my kids know, they fuck up, they take care of it on their own. Daddy will not bail them out, I am a corporate attorney and don’t do any of that criminal defense stuff.”

The officers involved were not available for comment at the time of publication.
